upzency is an online listing platform designed to help Agencies showcase their service packages and allow Clients to browse and connect with Agencies directly. We do not facilitate or participate in actual transactions, service delivery, or agreements between users. All engagements, service delivery, and payments occur directly between Clients and Agencies, outside the upzency Platform.
1.1 Definitions
For the purposes of these Terms, the following definitions apply:
- Agency: Any registered business or individual offering services by publishing packages on the Platform.
- Client: Any user browsing service packages or contacting Agencies through the Platform.
- Listing: A publicly visible service package created and published by an Agency.
- User: Any individual or entity using the Platform, whether as an Agency or Client.
- Platform: The website, tools, and features provided through .
2. Platform Role and Limitations of Responsibility
upzency is a friendly space where Agencies can showcase their service packages and Clients can discover and connect with them easily. Our role is to help make those connections possible — but we don’t take part in any actual service work or business agreements between users.
2.1 Agency Verification & Approval
To join the platform, Agencies need to sign up with a valid email and verify it using a one-time code. Once verified, they can build their public profile by sharing:
- Agency name and website
- Tagline and logo
- Year established
- Service categories
- At least one complete package
- Any other info we ask during onboarding
We do a quick check to make sure the details match up with what's publicly available (like the agency’s domain or branding). But just a heads-up — we don’t run deep background checks or verify business licenses.
2.2 What We Don’t Do
To keep things fair and open, here’s what upzency does not do:
- We don’t officially endorse or certify any agency or service
- We don’t get involved in project communication or contracts
- We don’t process payments between Clients and Agencies
- We don’t guarantee results, service quality, or client satisfaction
- We don’t mediate disputes or step in if something goes wrong
We also reserve the right to remove listings or content that we find misleading, low quality, or inappropriate — we want to keep the platform helpful and trustworthy for everyone.
2.3 A Quick Disclaimer
While we do our best to make the platform reliable and safe, upzency isn’t part of any agreements, payments, or service outcomes. Everything happens directly between Clients and Agencies. We encourage everyone to do their own research before making any decisions.
3. Package Listing and Usage Policy
Agencies can create and publish service packages that describe what they offer, how much it costs, and what’s included. We want listings to be easy for Clients to understand and compare — so we’ve put some basic guidelines in place.
3.1 Listing Rules
To keep things clear and helpful for everyone, all package listings must be:
- Accurate: Make sure your pricing, service details, and availability are up to date
- Honest: No false claims or misleading information
- Professional: Use clear language that sets the right expectations
Each paid package stays live for 30 days once published. Free listings are automatically renewed. Listings include info like:
- Package title and tagline
- Price
- Category
- Key features and deliverables
- Duration or timeline (if applicable)
We may also add more listing fields in the future to make packages even easier for Clients to evaluate.
3.2 Listing Visibility
Listings are shown on a rotating basis within their categories to give fair visibility to all. While some may appear higher depending on timing or relevance, we don’t offer guaranteed top spots or permanent front-page placement.
3.3 Client Inquiries
Clients can contact Agencies directly through the platform — and good news: responding to messages is always free. We never charge Agencies just for getting leads or inquiries.
3.4 Listing Types & Renewals
Agencies can choose between:
- Manual Renewal: You renew listings yourself when they expire
- Auto-Renewal: We’ll automatically extend your listing using available credits or under your free plan
Once a listing is published, it goes live right away and can’t be paused, unpublished, or refunded. So please double-check everything before you hit “Publish” — we recommend giving it a careful review!
4. Pricing Plans & Credit Usage
We offer flexible options to help Agencies of all sizes get started — whether you're just exploring or ready to scale up your visibility.
4.1 Free Plan
Every Agency starts with a Free Plan that includes:
- Up to 2 active listings
- No expiration — listings renew automatically
- No credit card required
It’s a great way for smaller or new agencies to test the platform and start getting leads without any upfront cost.
4.2 Pay-as-You-Go Credits
Need more listings? You can purchase credits anytime. Here’s how it works:
- 1 credit = 1 live listing for 30 days
- Credits don’t expire — use them whenever you're ready
- Credits are only deducted when you publish a listing (not while editing or saving as draft)
If you enable auto-renewal for a listing, it’ll automatically use credits when the 30-day period ends — unless you're still within your free limit.
4.3 Refund Policy
Once credits are used to publish a listing, they’re considered consumed and are non-refundable. If something goes wrong on our end (like a listing fails to go live due to a technical error), just reach out to our support team — we’ll be happy to help and make it right.

5. Third-Party Services
To keep things running smoothly and securely, upzency works with a few trusted third-party providers. These tools help us monitor performance, protect user accounts, and deliver a better experience overall.
Below is a list of services we currently use or may use in the future
- Google Analytics: Helps us understand how visitors use the platform so we can keep improving it
- Google reCAPTCHA: Protects forms from spam and bots
- Hosting and Content Delivery Networks (CDNs): Ensure fast, secure, and reliable access to the platform

6. User Responsibilities and Conduct
We want upzency to be a helpful, respectful, and safe place for everyone. To keep things running smoothly, all users — whether Agencies or Clients — are expected to follow a few simple guidelines.
Please make sure you:
- Only post accurate and honest information — no misleading claims or fake listings
- Treat others with professionalism and respect in all communications
- Don’t impersonate someone else or misrepresent your services or identity
- Don’t use the platform to post anything unlawful, offensive, or harmful
- Don’t try to interfere with the security or functionality of the site
- Don’t collect or store other users’ data without their permission
We reserve the right to suspend or remove any account or content that goes against these guidelines. Our goal is to maintain a trusted environment where everyone benefits from quality interactions.
7. Termination and Suspension
We hope everyone has a positive experience on upzency, but if someone breaks the rules or uses the platform inappropriately, we may need to step in.
Here’s what might happen if an account or listing violates our Terms:
- We can suspend or terminate accounts without prior notice for serious or repeated issues
- Misleading, offensive, or outdated listings may be removed to keep the platform trustworthy
- If your account is closed because of misconduct, any credits—used or unused—may no longer be available

8. Disclaimers
We want to be upfront about what upzency does and doesn’t do to keep everything transparent and fair.
Please note:
- We don’t guarantee the accuracy, quality, or outcomes of the services offered by Agencies on the platform.
- The platform is provided "as-is" and "as-available," which means there might be occasional glitches, downtime, or other issues beyond our control.
- We’re not responsible for any disputes, losses, or damages that happen between Clients and Agencies.
- We don’t mediate agreements or service outcomes — all business arrangements happen directly between you and the Agency outside of upzency.
Thanks for understanding that while we work hard to provide a reliable service, the actual service delivery and results depend on you and the Agencies you connect with.
9. Limitation of Liability
We want to keep things fair and clear about our responsibilities. To the fullest extent allowed by law:
- Platform Use: upzency, its team, and partners aren’t liable for any direct or indirect damages related to your use (or inability to use) the platform.
- Maximum Liability: If, for any reason, we are found responsible, our total liability won’t exceed the amount you paid us for services in the six (6) months before the issue happened.
- Listing Visibility & Leads: We rotate listings fairly so no one gets guaranteed top spots — and all client inquiries are free for Agencies.
- Third-Party Interactions: Since transactions and agreements happen directly between Clients and Agencies, we aren’t responsible for any disputes, payments, or service delivery issues that come up.
- Technical Issues & Data Loss: While we do our best to keep things running smoothly, occasional glitches or downtime might happen. We recommend keeping backups of any important info, as we aren’t responsible for interruptions or data loss.

10. Privacy, Data Usage, Hosting & Communication
Your privacy matters to us at upzency. We collect and use your information to make your experience better, safer, and more personalized.
Here’s a quick overview of what you can expect:
- We collect only the information necessary to provide and improve our services.
- We protect your data using industry-standard security measures.
- Your data is stored and processed on secure servers hosted by trusted providers located in the USA. We take all appropriate steps to keep your data safe and comply with applicable laws.
- To send you important updates, notifications, and support emails, we use trusted email service providers like Zoho. Your contact information is handled with care and according to privacy laws.
- We work with trusted third-party partners who help us run the platform smoothly (you can learn more about them in our Privacy Policy).
- You have control over your personal information, including access, updates, and deletion where applicable.
- We comply with international data protection laws like GDPR (for users in Europe) and CCPA (for users in California).

12. Governing Law
These Terms are governed by the laws of the Republic of India. If any disputes arise related to your use of upzency, they will be handled in courts located in India.
If you’re accessing the platform from outside India, you might have some rights under your local laws. However, as much as the law allows, these Terms and any disputes will be governed by Indian law.
We also comply with international privacy laws like GDPR (Europe) and CCPA (California) to protect your data no matter where you are.
13. Dispute Resolution and Arbitration
We hope you won’t have any issues using upzency, but if a dispute does arise, here’s how we handle it:
First, we encourage both parties to try resolving the matter through friendly, informal discussions for up to 30 days.
If that doesn’t work, any remaining disagreements will be settled through binding arbitration in India. This means a neutral arbitrator will make the final decision instead of going to court.
The arbitration will be conducted in English, following the rules of a recognized arbitration institution in India. The decision will be final and binding.
However, if there’s an urgent matter like protecting intellectual property or preventing harm, either party can seek immediate court relief in India.
By agreeing to these Terms, you also agree to waive any rights to a jury trial or class action lawsuit regarding disputes related to upzency.
